MA v. Karen Read (2024) – Day 17 Trial Summary
Day 17 of the Commonwealth v. Karen Read trial introduced the highly anticipated direct examination of ATF Special Agent Brian Higgins, a close friend of property owner Brian Albert and a key figure in the defense’s third-party culprit theory. The session focused heavily on mapping out Higgins’ post-incident movements, his early morning communications with law enforcement and the Albert family, and the complex historical romantic undercurrents between him and the defendant.
Higgins provided critical context regarding his departure from the Waterfall bar, his arrival at 34 Fairview Road, and his subsequent trip to the Canton Police Department. Crucially, the prosecution used this day to establish a potential motive for relationship instability or manipulation by reading a series of flirtatious, explicit text messages exchanged between Higgins and Read just weeks prior to John O’Keefe’s death, establishing a “weird vibe” and emotional friction preceding the tragedy.

Connection to the case
Guest at both the Waterfall bar and grill and the 34 Fairview Road residence on the night John O’Keefe died.
Summary Of Testimony
Higgins testified that after socializing at the Waterfall bar, he traveled to 34 Fairview Road, where he sent a text message to John O’Keefe at 1:09 AM asking, “are you coming here”. He stated that after leaving the residence, he never saw O’Keefe or Read again that night, proceeding instead to the Canton Police Department to shift administrative vehicles. Higgins noted that his phones began ringing heavily at 6:00 AM, receiving calls from Chief Berkowitz and Brian Albert, which prompted him to return to Fairview Road after learning O’Keefe had been discovered on the front lawn—a situation he testified “didn’t make sense” because he believed the couple had never arrived.
Furthermore, Higgins read a series of romantic text messages into the record from January 13th, 2022, where Read messaged him “you hot” and he replied “the feeling is mutual”, confirming Read had physically kissed him on a separate occasion. He testified he was actively trying to vet out whether Read genuinely liked him or was simply attempting to pit him against O’Keefe, concluding that while there was no sexual relationship, it amounted to a “weird vibe.” His direct testimony concluded with him reading a final, stark text message sent to him by the defendant: “John died.”
